Constitutional Law Indonesia
This chapter examines the Constitutional Court established in 2003 with jurisdiction over constitutional review of statutes, jurisdictional disputes, political party dissolution, election disputes, and presidential impeachment. Hendrianto traces the court's evolution from its first generation of academic-minded justices who sought to establish it as a 'knowledge institution' producing reasoned judgments, through subsequent leadership under which decision quality and intellectual coherence have deteriorated. The chapter analyses prominent election-related cases illustrating the court's struggles with the concept of 'open legal policy'. It also documents critical problems, including external political attacks through legislative amendments manipulating appointment and tenure rules, internal ethical scandals involving justices, and inconsistent decision-making that abandons previous decisions without adequate explanation.
