Abstract
This magazine article is about two things: (1) An attorney, in cooperation with local law enforcement, smuggled cell phones into the correctional center and wore a wire into the attorney-client interview room. The police recorded all calls on those phones and, of course, the conversations off of the interview-room wire. Over defendant's objection, the judge (correctly) admitted the conversations into evidence. (2) A law professor has written an article on the subject of attorney deception. The judge addressed the legal issues. The Professor addresses the ethical issues of attorney deception and, in the end he -- Professor Tory L. Lucas -- suggests an express "investigation deception" exception to the Model Rules of Professional conduct.
